Feed Contest Terms of Participation
1. Terms
1.1. By participating in the Feed contest (“Contest”), you (or the “Customer”) agree to be bound by the terms and conditions set out herein (the “Terms”), in addition to the Terms of Use [OWJM1] for the Platform, which are incorporated by reference into these Terms. For the avoidance of doubt, capitalized terms used and not defined herein have the same meaning as given to such terms in the Terms of Use. In the event of a conflict between the provisions of these Terms and/or the Terms of Use, the provisions of these Terms shall prevail to the extent of such conflict.
2. Conditions
2.1. The Contest is only available to Customers who are eligible users (“Eligible Users”). An Eligible User is a Customer who has installed the LAZADA mobile app and registered for a Lazada customer account with [Ecart Services Malaysia Sdn. Bhd.] (“Lazada”). Eligible Users will only be able to participate in the Contest on the LAZADA mobile app after they have logged in.
2.2 The specific rules on how to take part in the Contest can be accessed at the “How to Play” page.
3. Your Obligations
3.1. You acknowledge and agree that:
3.1.1. You shall comply with all applicable laws and regulations to the fullest extent when participating in the Contest
3.1.2. You shall comply with all third party terms (including, without limitation, any applicable terms of use, policies and guidelines) provided by sharing channels where such sharing channels are used to invite third parties to slashing sessions, and you shall not, as part of your participation in the Contest, breach any of these terms.
3.1.3. You are responsible for all information that you communicate, submit, transmit or otherwise make available during your participation in the Contest whether to Lazada or third parties.
3.1.4. You shall not participate in the Contest or permit the participation in the Contest in any manner which may adversely affect other customers' participation in the Contest or the goodwill or reputation of Lazada.
3.1.5. You shall not participate in the Contest in a fraudulent manner, including but not limited to participating in the Contest with more than one customer account or copying another person’s Contest entry. Each Eligible User can only participate with one customer account.
3.1.6. You are responsible for complying with the “How to Play” rules, these Terms, and the Terms of Use.
3.1.7. Participation in the Contest shall be deemed to constitute your unconditional and irrevocable acceptance of these Terms, the Terms of Use, and any other such terms as may be notified to you by Lazada from time to time.
3.1.8. Lazada, to the fullest extent permitted by law, excludes all warranties, rights and remedies (including warranties implied by statute or otherwise) that you would otherwise be entitled to by applicable law.
3.2. Where Lazada deems that you have breached of any of these Terms, or otherwise fraudulently participated in the Contest, it reserves the right to:
3.2.1. prevent or restrict access of any Customer to the Contest, the LAZADA mobile app, or any of the Lazada Platforms; or
3.2.2 report any activity it suspects to be in violation of any applicable law, statute or regulation to the appropriate authorities and to co-operate with such authorities.
4. Availability of Prizes
4.1. You acknowledge that the availability of the prizes awarded in the Contest is subject to:
4.1.1. the availability and functionality of resources including, without limitation, the availability and functionality of the Platform; and
4.1.2. the capability of Lazada’s systems at the time and location when the Contest is due to be operated or run for Eligible Users.
4.2. You accept that Lazada shall not be responsible to you for any loss, damage, fine, regulatory action, claim or compensation of whatever nature arising from or related to the Contest (“Liabilities”) including but not limited to (i) your breach of these Terms, (ii) any alleged unauthorised transactions, disruptions, errors, defects or unavailability of the Contest, or (iii) any loss of data or damage to any of your mobile equipment, to the fullest extent permitted by applicable law. In the event that any Liabilities are not excluded by the foregoing in this Clause 4.2, Lazada’s maximum aggregate liability to you in respect of such Liabilities, whether under all applicable laws of contract, tort or otherwise, shall be SGD 50 (or the equivalent value of such amount in the currency of your jurisdiction), to the fullest extent permitted by applicable law.
4.3. Lazada does not make any warranty or representation or undertaking on the performance and capability of the Platform, the Contest and/or any software or hardware the Contest, or the reliability or quality of the underlying telecommunications network accessed by you using the Contest
5. Data Collected by Lazada
5.1. When you participate in the Contest, we may collect information from you, which may include personal information such as photographs, name and username that you may upload, provide or use.
5.2. Any personal information that we collect may be used by us, or shared with or transferred to third parties (including related companies, third party service providers, and other Eligible Users), to organize, conduct, or facilitate the Contest as per the How to Play rules, these Terms, and the Terms of Use.
5.3. For the avoidance of doubt, the Privacy Policy shall apply to all personal information referred to under these Terms.
6. Miscellaneous
6.1. Any Clause in these Terms, the Terms of Use, the Standard Terms and Conditions, the Privacy Policy as well as such other terms and conditions as may be agreed or accepted by you, that are invalid, unenforceable or illegal shall be enforced as far as possible in accordance with its terms, but shall otherwise be deemed severed and shall not affect the enforceability of any other Clauses, terms and/or conditions which Clauses, terms and/or conditions shall continue to be valid and enforceable to the fullest extent permitted by law.
6.2. Lazada reserves the sole right to alter, modify, add to or otherwise vary these Terms from time to time, and in such manner as Lazada deems appropriate. In the event of variation of these Terms, if you continue to participate in the Contest thereafter, you shall be bound by the Terms as so amended and shall be deemed to have accepted the Terms as so amended.
6.3. Lazada shall not be liable for non-performance, error, interruption or delay in the performance of its obligations under these Terms (or any part thereof) or for any inaccuracy, unreliability or unsuitability of the Contest if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond Lazada’s reasonable control.
